Efinia operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). Efinia is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when you use the Services.

Efinia offers curated artisan jewelry, and many pieces are produced in limited quantities. Natural stones and handmade or artisan-made components may vary from piece to piece. Variations in color, pattern, shape, texture, size, finish, or other natural or handmade characteristics are part of the individuality of these pieces and are not necessarily defects.

Product descriptions and availability may change without notice. We reserve the right to discontinue products and to limit quantities available to any person, geographic region, or jurisdiction, subject to applicable law.

Jewelry materials, care, and use

Our jewelry may contain natural or semi-precious stones, plated metals, stainless steel, metal alloys, and other jewelry components. Available material information is provided in individual product descriptions where known.

Because jewelry may contain different metals, finishes, stones, and components, customers with known metal or material allergies or sensitivities should review the available product information carefully before purchasing and contact us at info@efinia.co with any questions. Individual sensitivities vary, and we cannot guarantee that a particular piece will be suitable for every individual. Discontinue wearing an item if irritation or another adverse reaction occurs.

Plated finishes, metals, stones, and other components can naturally change in appearance over time. Exposure to water, moisture, perspiration, perfumes, cosmetics, lotions, cleaning products, chemicals, friction, and other environmental conditions may accelerate wear, discoloration, tarnishing, or changes to the finish.

Please follow any care instructions provided with your jewelry or on our website. Normal wear, gradual changes in finish, and changes resulting from use or improper care are not considered manufacturing defects.

Jewelry and its packaging may contain small components and should be kept away from young children and pets.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase. Efinia reserves the right to accept or decline an order, subject to applicable law. Your order is not accepted until we confirm acceptance and payment has been successfully processed.

Please review your order carefully before submitting it. Because many Efinia pieces are available in limited quantities and orders may be prepared soon after purchase, we may be unable to accommodate cancellation requests after an order has been accepted.

If we decline, modify, or cancel an order, we will attempt to notify you using the contact information provided with the order. If we cancel an order after payment has been collected, we will refund the applicable amount to your original payment method.

Purchases are subject to our Returns & Refunds Policy.

Purchases are intended for personal or household use and not for commercial resale or export.

SECTION 4 — PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price applicable to your purchase at the time your order is placed, subject to correction of errors as described below.

Unless otherwise stated, displayed prices do not include applicable taxes or shipping charges.

We make reasonable efforts to ensure that prices, product descriptions, promotions, availability, and other information on our website are accurate. Occasionally, information may contain typographical, technical, pricing, or other errors.

We reserve the right, to the extent permitted by applicable law, to correct errors and to refuse or cancel an order affected by an obvious pricing, product, or listing error. If payment has already been collected for an order we cancel, we will refund the applicable amount to your original payment method. We will not charge you a corrected higher price without your authorization.

You agree to provide current, complete, and accurate purchase, payment, and account information and to update that information as necessary so we can complete your transactions and contact you.

You represent that you are authorized to use any payment method you provide and agree to pay all properly disclosed charges associated with your purchase.

SECTION 5 — SHIPPING AND DELIVERY

Delivery dates and transit times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, service interruptions, or other circumstances outside our reasonable control.

If your package arrives damaged, contains an incorrect item, or you experience another problem with delivery, please contact us at returns@efinia.co so that we can review the issue and help resolve it.

Shipping charges and any applicable free-shipping thresholds are displayed during the purchasing process or elsewhere on the website.

SECTION 6 — RETURNS AND REFUNDS

Returns, exchanges, damaged items, and refunds are governed by our Returns & Refunds Policy.

For hygiene reasons, earrings are final sale and cannot be returned or exchanged, except where an item arrives damaged or defective, an incorrect item is received, or otherwise as required by applicable law.

The Services, including trademarks, brand elements, text, photographs, graphics, video, audio, and the design, selection, and arrangement of such materials, are owned by Efinia, its licensors, or other applicable rights holders and are protected by applicable intellectual property laws.

Efinia's name, logo, and other Efinia brand elements may not be used without our prior written permission. Shopify's names, logos, and other marks are trademarks of Shopify or its applicable affiliates. Other names, logos, products, and brands appearing through the Services remain the property of their respective owners.

SECTION 8 — OPTIONAL TOOLS

You may be provided access to tools or functionality offered by third parties as part of the Services. We may not monitor or control these tools.

Such third-party tools may be provided “as is” and “as available,” subject to the terms and policies of the applicable provider. Your use of optional third-party tools is at your discretion and risk.

Efinia is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Efinia. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Efinia, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Efinia.

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Services are hosted by Shopify, Shopify may collect and process personal information relating to your access to and use of the Services in order to provide and improve the Services. You grant Efinia a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, and distribute Feedback in connection with operating and promoting Efinia and the Services, subject to applicable law.

You are responsible for the accuracy and content of Feedback you submit. We may remove Feedback that we reasonably determine is unlawful, abusive, misleading, infringing, obscene, or otherwise inappropriate.

Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, availability, or other information.

We reserve the right to correct errors, inaccuracies, and omissions and to update information or cancel affected orders where permitted by applicable law. If we cancel an order for which payment has already been collected, we will refund the applicable amount to your original payment method.

TO THE EXTENT PERMITTED BY LAW, EFINIA IS NOT RESPONSIBLE FOR DAMAGE RESULTING FROM FAILURE TO FOLLOW PRODUCT CARE INSTRUCTIONS, USE OF A PRODUCT IN A MANNER FOR WHICH IT WAS NOT INTENDED, OR CONTINUED USE AFTER DAMAGE, BREAKAGE, OR IRRITATION BECOMES APPARENT.

Individual allergies and sensitivities vary. Customers with known sensitivities should review available material information and contact us with questions before purchasing.

Nothing in these Terms excludes, restricts, or limits any liability, warranty, remedy, or consumer right that cannot lawfully be excluded, restricted, or limited under applicable law.

We will provide reasonable notice of an indemnifiable claim where practicable and may participate in or control the defense of such a claim as permitted by law.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the extent necessary. The remaining provisions will continue in effect.

These Terms and any separate agreements through which Efinia provides the Services are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent applicable federal law or other mandatory law provides otherwise.

Nothing in this section deprives a consumer of protections or rights that cannot lawfully be waived.
